Default Roy Warden Not Guilty: Free To Burn More Mexican Flags

From KOLD News 13, Tucson, AZ

Roy Warden considers himself a revolutionary, "do you guys want a
statement or do you want to just hear from the Mexicans?" Warden asked a
group of reporters as he strolled out of Tucson City Court.

Such comments are why Tucson's Latino and immigrant communities call him
a white supremacist. Over the year he's made quite a name for himself in
the Old Pueblo.

(Editor's Note: Mr. Warden's attorney, USJF's Gary Kreep, said that
fellow flag burners included an African-American male and a Hispanic
male — Mr. Warden is not a white supremacist as the article implies.)

On April 10, 2006 Warden burned a Mexican flag in the midst of a huge
immigrant rally in Armory Park. A brief riot ensued and Warden was
charged with assault, criminal damage and reckless burning. He was
eventually acquitted.

Over the summer another incident brought more charges, "you step in
there I'll put a bullet in your f***kin' head, you got that?" A deranged
looking Warden yelled that threat right into the camera 16-year-old
Arturo Rodriguez was holding. Rodriguez went to the Mexican Consulate's
office in late July last year to videotape Warden burning another
Mexican flag. The video became a key piece of evidence in the case
against Warden.

Last month he was found guilty of assaulting, threatening, and
intimidating Rodriguez.

On Monday, Jan. 22 Judge Hays placed Warden on three years unsupervised
probation and took away his gun rights, "Mr. Warden had his right to
possess a firearm denied for three years," explained Warden's attorney
Gary Kreep who is the Executive Director of the United States Justice
Foundation (www.usjf.net), "even though Arizona law says you can only
take a person's right away if they're convicted of a felony which he was
not." It doesn't appear the judge's order will stop Warden from packin'
heat, "if you attempt to commit an act of violence against me," a
defiant Warden said right outside the courtroom, "I will draw my sidearm
and blow your f***in' head off. That's what I told Arturo then that's
what I told the judge up in the courtroom...nothing changes."

Judge Hays also ordered Warden to stay away from all public
demonstrations, which according to Warden's lawyer is beyond Hay's
power, "if he goes to a pro-life or pro-abortion rally he can be
arrested which is a clear violation of his constitutional rights."

While Warden and his attorney think the punishment is too much the
victim in the case, Arturo Rodriguez, feels it wasn't enough, "if this
is Judge Hay's form of justice then there is no justice."

Despite being threatened by Warden, Rodriguez has a hint of admiration
for him, "I actually respect the guy because he's brave enough to oppose
what most of the city is standing for and what the city believes. He's
respectable except for the fact that he threatens little kids."

Warden plans to appeal Judge Hay's ruling saying he'll take Hays down in
federal court for deliberately violating his constitutional rights.

Notice how the press focused on the latino position. We can anticipate
many burnings of the Mexican flag during the next Stinko da Mayonaise
celebration.

Max

And the nerve of that old fart, Judge Hay's, for his flagrant attempt
to supress Mr. Warden's constitutional rights.

Right now it's 28F according to my thermometer, and the wind is whipping
branches around. Supposed to start snowing soon. Hell, it's too cold and
windy to hit balls at the local heated and covered driving range.

Miserable!

Temperatures here are expected to drop to single digits come Sunday. We
also have about 6 inches of snow (a couple of feet 30 miles further east) on
the ground.

Although I am going stir crazy because of being housebound after my
operation at least it is happening during the worst of the winter rather
than during the peak of summer!

Winter may be over in the Northwest. I hope. We had about two months
of almost non-stop rain, three enormous windstorms, and an unusual
spell of temperatures well below freezing.

While it has been cold at night, the days are primarily sunny and
bright. Just in time for the local boat show. Attendance last Saturday
set an all-time single day record for the show, and it's been average
or busier than average just about every other day. The January
sunshine has people thinking about, and absolutely buying boats. I
know of dealers that have sold their entire allocations for 2007, a
local catamaran dealer closed six boats all 26-feet or larger in one
day, and even the mega dealers are all smiling - all but whistling and
jingling pocket change as they stroll around the show. It looks like
it's going to be a *very* good year for the boat business, and that's
good news for private parties as well. The values of boats owned will
tend to be a bit higher- or at least not depreciate quite as quickly,
when there's a strong demand. (Sure hope all these new boats will find
moorage......)

80 degrees in SWFL, wind SSW 17 gusting 22.

Went for a quick ride in the inflatable at lunch time to check out the
new Honda BF20. Seems like a nice little engine although a bit
heavier than I would have liked.

We're not that cold, but it's not going to break out of the 30's very often
in the next couple weeks. That's too cold for boating and too cold for
golfing. I wish I had a treadmill!

Killer tornado, one mile south of our home early this morning. Lady Lake,
FL.

That's too close for comfort.
