If there is any doubt, you should ask. If you are not under arrest
you should decline to be detained until you get legal counsel.

C'mon. Cop wants to talk to you for a few minutes because
you were in the wrong place at the wrong time.
He wants to eliminate you as a perp, and he has his hands full
so it may take a while. No sense getting into a discussion with him
about "detainment" and "arrest" and lawyers. The results of that
will most likely be time-consuming, stressful and costly. Best be
helpful.
There are cases where innocent people get framed for a crime.
If you find yourself in a police station room with a cop asking
you detailed questions about something you know nothing about,
that's the time to clam up and get a lawyer.
Just watch a few episodes of COPS for how it works in the street
and some "investigative" shows for when not having a lawyer
can be a bad thing.
