My bet is he is acquitted of the murder one beef and gets convicted on one of the other lesser charges but it is really meaningless since the sentence for any of them, even the aggravated assault, will be "20 to life". (the OTHER controversial Florida gun law that blunts stand your ground) From what I can see so far, the guy is guilty of at least second degree murder... maybe even first. I think the last three shots into the back of the car seal that deal. Be hell trying for a murder one. Where is the premeditation? How many armed robbers get a murder one after killing someone in a robbery? Most get Murder 2/ manslaughter. Yup, that's exactly what I said.... "at least" guilty of second degree murder"...*maybe" first. And the premeditation was after the first volley, the second three shots. I know it's a stretch but if they could somehow prove the kid was in fact killed in the second volley... *maybe* but I do agree, doubtful... |

I don't remember seeing it and that is what the law affords the defendant. If the case ever makes it to trial, the defense is a standard self defense case, based on the "use of deadly force" law. Dunn is basing his defense on the claim to have seen what he thought was a weapon. I doubt it will work for him but if he was a cop, it would have never even come to a trial and nobody would have questioned the 10 shots. That is the crime.. Cite what? That Dunn mentioned stand your ground as a defense? It's been all over the news reports.
