I am a gun guy but I am forced to ask, "how did he know he was in
imminent danger"? Without answering that question in a way that would
convince a reasonable person, he has a good chance of going to jail.



Here's a better question...did he know the person he shot was his
stepdaughter? Here's another...was he stupidly just shooting at the
location of some sort of noise, without knowing what he was shooting at?
You would think that before someone shoots another person under the
circumstances as described in the news story, the shooter would take a
second to determine if the target was friend or foe.

Not as Herring the Racist says, "How the hell was the
owner supposed to *know* it was their kid?"

By looking at who you are about to shoot, asshole.

Assuming there was enough light to see an asshole!

My understanding of castle laws and the use of deadly force is that one
still has to have reasonable presumption of fear of death or great
bodily harm. The only difference from other self defense laws is that
you are not obligated to evade or try to escape from the perceived
danger if you are in your home.

I am not sure this situation met those standards.

Either am I. That's why I said it's hard to make a judgment. (Of course, that's been snipped.) If
the guy committed a crime, then he should suffer.

Here's another comment:

Colorado has a 'Make my Day' law which allows shooting under certain circumstances. I suppose we
should let the investigation determine if those were met. Apparently the police are still
investigating.

Unlike some folks here, I don't find the guy guilty yet.
