On what basis would he be sued, **** for brains? Is he discriminating in
some way that is illegal, such as on the basis of race or gender or age?

If it is a case of endangering someone's safety by denying them fuel
in the winter he could be criminally charged. (reckless endangerment)
but in this "everyone is a victim" society, a civil discrimination
case is not out of the question. Gays are not a protected class in
civil rights law or the 14th amendment but they sue people all the
time.
New protected classes seem to pop up every day.
