![]() I shot your daughter! A 14-year-old Colorado girl was shot and killed by her stepfather early Monday morning after he mistook her for a burglar entering their house. KOAA-TV reported that police found the girl in the basement, having suffered a gunshot to the chest. She later died at a local hospital. The Colorado Springs Gazette reported that the shooting took place around 6 a.m. Monday. Police were initially called to the house to respond to a burglary attempt. |

Very bad, but somewhat understandable. It will be interesting to see what the police investigation shows. On the other hand... Joseph Eisel, 51, was asleep with his wife around 3 a.m. when he woke to a 27-year-old man he did not know standing over his bed. Startled and fearful for his life, Eisel reached for the 9 mm pistol he keeps bedside. The intruder fled the room and entered the Eisels’ garage. Eisel followed him into the garage where the intruder fell to the floor. Eisel ordered the intruder to stay on the floor while his wife dialed 911. Eisel held the intruder at gunpoint until police arrived a short time later. The intruder allegedly entered the home through a broken basement window. Reportedly no one was hurt during the home invasion. “Everybody complains about guns,” Eisel said of the incident, “but I’m glad I have one.” (Butler Eagle, Cranberry Township, PA, 10/1/13) Thank goodness he had a gun, eh? I am a gun guy but I am forced to ask, "how did he know he was in imminent danger"? Without answering that question in a way that would convince a reasonable person, he has a good chance of going to jail. Here's a better question...did he know the person he shot was his stepdaughter? Here's another...was he stupidly just shooting at the location of some sort of noise, without knowing what he was shooting at? You would think that before someone shoots another person under the circumstances as described in the news story, the shooter would take a second to determine if the target was friend or foe. Not as Herring the Racist says, "How the hell was the owner supposed to *know* it was their kid?" By looking at who you are about to shoot, asshole. I go along with Greg. But daughter should not have been sneaking out and in in middle of the night. Neighbor has one of those kids. Now pregnant and living with boyfriend. She was busted with alcohol when she was about 14. In auto accident in Oakland, 30 miles away at 3 am. Had snuck out at midnight. Maybe bad parenting as well as bad kid. His other 2 kids seem to not get in trouble. So maybe just bad kid. |

John H. -- Hope you're having a great day! My understanding of castle laws and the use of deadly force is that one still has to have reasonable presumption of fear of death or great bodily harm. The only difference from other self defense laws is that you are not obligated to evade or try to escape from the perceived danger if you are in your home. I am not sure this situation met those standards. Either am I. That's why I said it's hard to make a judgment. (Of course, that's been snipped.) If the guy committed a crime, then he should suffer. Here's another comment: "Police say the stepfather hasn't been arrested and prosecutors will have to determine if charges are warranted. I suppose we should let the investigation determine if those were met. Apparently the police are still investigating. Unlike some folks here, I don't find the guy guilty yet.
