Default Recreational Craft Directive

The EU website - www.europa.eu.int - contains the definitive version.

In short, all boats sold in or imported to the EU after (I think) June
1998 must be certified to conform with the directive. There are a number
of exceptions, one of which are that homebuilt boats only have to conform
if they are sold on less than 5 years after completion.

My question is now: What is the situation if you build your own boat
outside the EU and want to import it, e.g. in connection with moving into
the EU? Does importing or homebuilt take precedence?


In the UK, homebuilt.

Self-built boats still in the ownership of the builder and not placed on
the market or intended to be placed on the market within five years of
completion of construction fall outside the scope of the directive. The
rules relating to importation only apply to boats which fall within the
scope of the directive.

Please, I don't want a discussion on the practical issues or whether the
rules make any sense; only the leagal situation.


Your safest bet would be to speak to whoever is responsible for
enforcing the directive in your own country. As I've said, the
interpretation and enforcement of the rules differs slightly between
Member States.
