At what point does the diver, mountain climber, skydiver, hang glider,
etc accept personal responsibility for the risks of his or her chosen
pastime? Should the legal system "nanny" everybody all the time?

Only if the dive operator claimed that the activity was entirely safe
and that normal reasonable people should undertake it, (rather than,
as the website notes, those looking for an extreme experience) would
he be at serious risk for criminal or maybe even successful civil
prosecution. IMO.
