Metz Manta Marine VHF Antenna w/optional Bow Rail Mount

Seller did not ship with the bow rail mount and is now disputing his
auction. He states the mount is optional even though this is the wording
on his auction. He is willing to refund amount of antenna but not
shipping and I have to pay for shipping back to him.

His wording was unclear and the word "with" seems to indicate that the
Bow Rail Mount was included. IMHO, he needs to do the right thing and
send you a Bow Rail Mount. FWIW, he has changed the wording in the
current ads to reflect that the mount is pictured, but not included.

Nothing unclear about it. With is with. His add stated that the optional
mount came with this antenna. I paid $10 more for his auction over
another just to have that mount. He said the mount isn't available so
the auction doesn't include the mount. It just means the mount is
optional. Uh excuse me? If it's optional it wouldn't be listed except to
say its on another auction or could be bought for X of $. W/ means WITH
aka INCLIUDED.

He wrote ebay to have my account suspended so I couldn't leave him
negative feedback.

Never ran across a seller like this before. Most make it right.

Did you pay with PayPal? or crdit card? If it was cash he's a SOB and
you are SOL, But with plastic, you might be able to dispute and have
your funds withdrawn until he "makes it right"

I have successfully done chargebacks on several occasions to Paypal with
my credit card, which is why I always use a credit card when paying with
Paypal. In my chargebacks, the sellers did not ship the goods, and maybe
that's the difference because in the quotation above it says,
"unsatisfied with". In any event, Paypal is worse than useless in disputes.

I'm not saying that it's not against their TOS to do chargebacks, but I
haven't lost my Paypal account either.

Never let cash sit in your Paypal account when someone pays you. I use a
Paypal debit card and withdraw funds immediately.

Go though the Ebay dispute process (not the Paypal one). It takes
time, but can work in the end.

If the add is still in Ebay, the one you purchased, make sure to print
out a hard copy (or even better, use something like "Auto PDF995" and
'print' a .pdf file of it).

Mistakes do happen, it is ones character that shows when they do...

Good luck!

If it was with PayPal, chances are that you are worse off than if you
paid cash.

What nonsense. I've had two (out of over a thousand) purchases run through
paypal that I disputed. Once was the result of destruction in shipment (and
others likewise had trouble) and the other was non-delivery of goods. Both
times they refunded the amounts to me within a week. Oddly enough even
after refunding to me the seller eventually DID get around to sending the
items 3 weeks later. Go figure.

Bearing in mind you can also indicate you want to pay the amount using a
credit card (not a direct transfer) and still retain that channel to seek
refunds.

I would agree. I pay for all ebay purchases with Paypal, using my credit
card as the funding source. If other on line purchases can be made using
Paypal, that would be my choice of payment. If things go sour one can
always file a case with Paypal and with the credit card company. Paying
with cash leaves you high and dry if there is a problem with the purchase.
I have not been screwed yet and I have several hundred ebay transactions.

If one has the discipline to pay off their entire credit card balance
monthly (as I have always done and as my kids have been taught to do) then
paying with a credit card is the smartest way to go. It can sometimes
result in no payment due for close to 60 days......free money during those 2
months. We also collect credits for BP gasoline cards with our BP Visa,
making it an even better choice.

We are in the final stages of major home improvement projects (started in
March), with the final project (master bath) now about 1/3 completed.
Although we have the cash, we paid a good % of the projects and associated
merchandise with credit card, earning us over $300 so far in BP gas cards.
How can you beat that?

It's going thru Paypal now.
He's willing to refund my money, but wants me to pay to have it shipped
back to him. To me, it's his bust. I wouldn't be upset if he didn't lie
about it and cover his tracks.
When I called him to say the mount was missing he said it's supposed to
be there. Went on to say he would call me back after he called his
warehouse to find out why they left the mount out.
Called back an hour later to say mounts are not in stock and what I
wanted. I said, the mount, when it comes available.
Instead of saying ok, he said no, it's optional and not included.
Huh? What?
Before I could say anything else, he said the mount is not included, and
that's not what the auction said. Her shifted gears quickly.

I saved the auction. The listing shows up on the dispute in paypal with
the wording, "with optional mount".

He goes by JNM supply as well. Winter Haven, FL.

Out of curiosity, what did you pay for the antenna?

And why did you buy a Metz?
