Is it a copyright violation if he leaves out pertinent paragraphs (unsupportive, I mean), or adds some words, or changes some words? Yes. Even though he omitted the last paragraph of the Borowitz piece, it is still a copyright violation. Posting 6 of the 7 paragraphs, or 85% of a copyrighted work without permission is not an "excerpt" and not "fair use." If he adds or changes a few words, then Harry can't attribute them to Borowitz, but by not giving the attribution, he would be engaging in good old fashioned plagerism. Basically, if Harry writes any thing about Tom Cruise's sister joining the Bush staff, he is ripping off a story from Borowitz. Harry knows how do this correctly, but I'll bet I know why he chooses to do it the way he does. |
