Credit unions are subject to federal regulation and would probably be
forced to pass. I was on the board of directors of a credit union in
a past life. The problem is that weed is still illegal at the federal
level.

There are all sorts of conventional money laundering schemes that
could be made to work but most are illegal if caught by the feds.

The law requires that trades and businesses report cash payments of
more than $10,000 to the federal government by filing IRS/FinCEN Form
8300, Report of Cash Payments Over $10,000 Received in a Trade or
Business. Financial institutions are also obligated to know the
source of all incoming funds. Breaking transactions up into multiple
smaller units, aka smurfing, is also prohibited.


Maybe a state chartered bank?

I did some reading on how some of these pot shops are doing their
banking and financing in some cases.

Apparently some small, private credit unions are welcoming their
business. They may be taking a risk however the chances of the
fed going after them are small. It won't be too long before
pot becomes legal at the federal level. Too much revenue to
ignore.


I don't think that will be as easy as it sounds, particularly
recreational pot. A few backward state senators could stop that.
The medical pot is much easier and might be fixed with a simple change
at the regulatory level by moving cannabis from Schedule 1 to Schedule
2. It would then be on the same tier as Fentanyl, Amphetamines and
Cocaine.

OTOH if they really want to fight this, there is a good chance the
whole controlled substance act could be tossed if 30+ states attorneys
general pushed the case that the feds do not have the constitutional
authority to regulate drugs that are not crossing state lines.
One day, we might reinstate the power of the 10th amendment and all
hell would break loose then. That might endanger a whole lot of
constitutionally questionable laws passed in the Nixon administration.



Well, it must not be all that difficult because certain credit unions
have established traditional banking services with pot retailers for
years and some regular banks are now joining. When recreational pot
became legal here in MA the retailers had no problems working initially
with a credit union in Gardner, MA and now others have opened their
doors for the pot business.

I think they realize that legalization at the federal level is not that
far off and the feds are always interested in new taxes and revenues.

I doubt anyone is going to go shut these retailers or credit unions down.

BTW, the credit union that offered financial services to the MA pot
shops is a Federal Credit Union.

An LLC that is a member of another LLC should do it.
