I was over in Virginia last week middle the week trying to get a part for my wife's rug shampooer. Out in the strip mall parking lot, I saw a guy physically and verbally abusing a woman and her child. He was slapping the woman and pulling on the child. I asked him to stop. He got verbally abusive towards me and then he took a swing at me. He missed. I swung at his face as hard as I could with my right hand and connected. He fell to the ground but I didn't knock him out just staggered him. I told the woman to call the cops but she didn't want to. She thanked me and she and the kid got in her car and drove away. The guy I hit got up and gave me a dirty look and got his car and drove away. My lower arm and wrist hurt like a son of a bitch so I ended up at the ER this past weekend and x-rays showed I busted a couple of bones in my wrist in hitting the parking lot asshole. No good deed goes unpunished. So, no typing. My goodness. That's a real good one. Best whopper from harry for a while... |

I don't live in Florida and i saw no need for deadly force. The strange thing in the law is, if he was seriously injured or if he died, you might as well have shot him. You could still be sued, just for hitting him. Why didn't Harry pull out his concealed firearm and shot the guy, Harry says that he has a CCW that allows him to carry in Virginia and since it is the home of the national right to work he had reason, in his mind, to carry. === In Florida the guy was guilty of two felonies, assaulting a female and child, and attempted assault on a senior citizen. That makes it very close to a valid "stand your ground" defense here, maybe not so much in Maryland or Virginia. On balance it was probably not a justified deadly force incident. It would be however if someones life or health had clearly been at risk. |
