Yup any fireman or cop who retires on disability is immune from state

or federal taxes on their pension.

BTW I am sad about my neighbor, He had a massive stroke last night and

did not wake up

RIP Les Stacho. We will miss you.

Only up to 50% is tax free. But here in California 90+% of firemen retire

on disability. Seems as if they could do the job for all 30 years, but

get.a disability rating on retirement. I thought Florida had no personal

income tax.

He was not paying ANY federal income tax.

Cite?

A legal decision that reaffirms this.

Oh, man.....

"The IRS argued that the benefits paid after turning age 50 were taxable

retirement income. It cited Tateosian, TC Memo 2008-101, where the Tax

Court held that because a disabled pensioner?s disability benefits

effectively terminated under Minnesota law once he turned age 50 and

became a deemed service pensioner, his payments could no longer be

characterized as compensation for personal injuries under SS104(a) for

federal income tax purposes."

Keep reading:

"The Tax Court determined that the benefits were nontaxable and rejected the IRS’s reliance on Tateosian. Instead the Court looked to precedent from the Ninth Court, to which an Appeal case would be heard and determined that the payments were not retirement benefits because they were determined with reference to his age and years of service.

For purposes of qualifying for retirement, the fact that the plan deems time spent on disability as equivalent to time spent working does not change the treatment for federal income tax purposes. So if someone completed less than 20 years of service, they would not be eligible for retirement payments; therefore, the character of the payments are *nontaxable* disability payments for federal income tax purposes."

"Oh, man" is right..

Negotiations with public employees are done under the direction of
elected public officials.

Who are lobbied by the same unions they negotiate with and who will
endure the wrath of those same unions at the polls if they actually
argue with any of the union demands.
In the case of some public service unions,, the union negotiator may
even be paid by the city.

Here in the sf Bay Area, BART the semi rapid transit, is going on strike
for a 23% raise over the next 3 years. They already are among the highest
paid transit workers in the nation. Average driver makes $73k salary with
an additional $66k in overtime. Plus fully paid retirement and $93 a month
for a medical plan no matter the size of the family. The SEIU leader has
already declared WAR in those words.

SF should do like other places and pave over the tracks and call it a
bike path.

Their BART, along with their MUNI lines and county transits actually
work well and carry a LOT of people who if not for their systems would
be funneled across a few bridges, and that isn't cheap neither? HEY
BILL, what's the toll across the bridges these days?

$5 for car, towing the tandem axel trailer, $20!
Sure they carry a lot of passengers, buy why do you have to pay a janitor
$60k a year? The drivers call in sick, and another guy takes his shift at
overtime, and the next day they reverse who calls in. Known scam.

But it takes a lot of money to live out there.

Well it does not take that kind of money. Lots of areas that are very nice
and do not cost millions to buy a house. My city is one of the highest
income towns in the USA, and there are areas where you can buy a house for
$500k. When a person with a GED that sits in the cab of the BART train and
his only job is to make sure no one is stuck in the doors, or to drive the
train, on tracks, to the next station at 25 mph, he should make more than
teachers? You sound like a typical government employee. There employee
expense ratio are the highest in the nation.

Maybe they could just do like you, Harry Krause: Don't pay their taxes to the government, run up large credit card debts and then file bankruptcy. Eh?

You notice the cheap places to live are usually "right to work"
states.

The right to work for less, the right to have less safe jobs, the right
to have less opportunities for health insurance, the right to have less
clean air, clean water...

The SF Bay Area is a lot bigger than San Francisco! SF is only about 46
sq miles in size. Plus SF has the highest cost of government in the
country I think. It is run by unions. SF is about the same size and
population as Indianapolis and spends 2X on government. And no snow
removal.
