defines what functions the federal government is allowed to perform. MOST
of what the federal government does is contrary to the constitution, so in a
way, you are correct. The constitution over the past 50 years applies
primarily to criminals and perverts.


again, where is this in the constitution? where does it say the feds
can't create a dept of education?

Your turn, show me where the constitution "delegates" education to the
federal government.


Public K-12 education has not been *delegated* to the federal
government. Obviously the feds have influence over public schools in
some areas, but they aren't running the schools. "Delegate" has a
meaning that implies a lot more than is happening.

It doesn't say you can't screw sheep in your front yard, either, so go to
it! (If you live in New York, Maryland or Tennessee).

The constitution defines the functions of the U.S. government. It does not
itemize what it cannot do! It further defines what the feds are restricted
from doing to YOU.

Read it sometime, it's really short. Congress doesn't.

Try reading some of the amendments. There's quite a list of "don'ts"


The don'ts are what they cannot do, to you. Or currently, what they
shouldn't do to you now that the document is a mere artifact.

As so well pointed out by another poster, the 10th amendment says,
paraphrased, "...if it ain't in here as an authority, it is reserved to the
states or to the people."

In case you skiped elementary education, the constitution defines what it
CAN do, and well as prohibiting what it cannot do to you.
