Please explain why it's OK to kill suspected Taliban or al Qaeda while
they're running around on the ground, but we have to have a judge and
jury for one who is trying hard as hell to actually kill us.

They shouldn't have been tried at all. They were prisoners of war.
They get let loose when the war's over.
