That's my good friend at the wheel. He used to own a Cape Dory Typhoon,
but is boatless until he moves out of the city. His wife is on the left
swapping lifejackets on the kids. Suzanne is on the right. We're only
under main, just after a tack...and about an hour before the sail
tossed a baton somehow!

I now have pics of the 35s5 taken from my dinghy with Suzanne sailing
and also shots of me at the wheel, but you'll have to wait until the
35s5 webpage is done! Should be in about a week. I need more shots to
finish.

Looks like the law is being broken to me. The kids are not wearing PFDs,
which is required by state law in most states. "Swapping" lifejackets should
have been done below decks.

What age must wear PFD: Under age 12.
Vessel Length: See PFD Types.
When PFD
Must be Worn: Must be worn while vessel is underway.
Approved
PFD Styles: L.O.A UP TO 40 FEET: Type I or II when operating on Great
Lakes and oceans; I, II, or III when operating on inland waters other than
Lake Erie or Lake Ontario. LOA 40-65 FEET: All USCG Approved.
Exceptions when PFD does not need to be worn: When in a fully
enclosed cabin.




A Coast Guard proposal that would require all youngsters under age 13 to
wear a life jacket when on the deck of a boat underway -- except in those
states that already have a children's life jacket law -- was the subject of
a Congressional hearing in mid-May.

Testifying before the House Coast Guard and Maritime Subcommittee, BoatU.S.
Government Affairs Vice President, Michael Sciulla, pointed out that while
boaters are encouraged to wear life jackets when appropriate, this proposed
new requirement would not necessarily save many lives.

"When you investigate and analyze the actual boating accident reports it
turns out that of the 31 children under age 13 who drowned in a boating
accident in 1999, 18 of the 31 were from states that already require
children to wear a life jacket, eight were already wearing a life jacket but
perished, two died while the boat was at anchor and three were swimming, not
boating, accidents," he said. An average of 13 children died in each of the
three years 1996-1998.

"Without a concomitant increase in funding for law enforcement at the state
level and a commitment by the Coast Guard to dedicate more manpower to its
modest boating safety efforts on the navigable waters of the U.S., we are
unconvinced that the federal government is in a position to dictate to the
states on this issue," Sciulla said.



Effective December 23, 2002, in states where no children's life jacket law
is in place, a new U.S. Coast Guard interim rule will require children under
13 on moving boats to wear a U.S. Coast Guard approved life jacket that
fits. Fifteen states will be affected by the rule.

This new rule does not change or supercede the existing law in states which
have life jacket laws, it only applies to states which had no laws. Please
see the list below for the latest laws in your state.

Please note that these laws provide boaters with the minimum age that a
child is required to wear a life jacket. It is still a parent's
responsibility to decide if a child should wear a life jacket, even in
situations where the law does not require it.
