Maybe not. One provision of that law is that it must be associated with interstate commerce. Email qualifies because it's a business tool, but I wouldn't think usenet does.
The internet itself is considered a form of interstate commerce under
United States Code.
Actually, it's considered a "channel" of commerce over which interstate (and international) commerce takes place. The power of regulation seems to hinge around activities having an economic impact. And as you know, if you've been following the attempts to regulate internet activity by state and federal governments, it's far from being settled.
