You're approaching the question backwards. Liability policies don't
pay
because the injured party was an innocent bystander. They pay because
their
insured was at fault. So the answer is that if the liability carrier
believes its insured was at fault, as opposed to simply the victim of
an
unfortunate accident, it will pay for the injuries to the others.

A fine distinction, I know, but our society is becoming more and more
absorbed with the idea that anyone who is injured somehow is entitled
to be
paid for the injury by someone else, regardless of fault.


It's called socialism. It's a plank in the Democrat party platform. It's
taught in the liberal public schools. Never take personal
responsibility. There's always somebody else at fault. Blame them.
Demand they pay. And if they can't pay then demand the government pay.
Keep raising taxes.
