Default Rule 5 NOT violated

Every vessel shall at all times maintain a proper
look-out by sight as well as by hearing as well
as by all available means appropriate in the
prevailing circumstances and conditions so as
to make a full appraisal of the situation and
of the risk of collision.


Ellen's vessel was geared to manage this at all times. She violated no
rule. If you take this rule literally, you can't even go below for an
instant. In addition to this, her vessel was carefully tracked during
the voyage and it's course made precise beyond Neal's wildest dreams.
Sorry, Neal. You lost again! (Not that you were ever taken seriously to
begin with!)Ellen is a real sailor because she makes it her life and
it's her career. Neal can't claim the same.
