upwind and can't point any higher, he can tack away to avoid a

collision.

That is nonsense. Why should an overtakING boat tack right away from his
desired course when he can ease sheets, pick up speed and pass clear to
leeward of the overtaken boat? Think about it. Go or a sail sometime.

No you didn't but you said it was 'a' choice and if you had thought about
it for a bit you would have seen how stupid that would be for a boat that
was attempting an overtakING.manoeuvre.
But hey! I see from some of your subsequent postings that you have taken the
trouble to get hold of and read the Colregs since your initial admission
that you did not know what was in them. So there may be hope after all.
