Here's the problem:
Trump never appointed Berman.Â* Jeff Sessions appointed
Berman as the *interim*Â* southern NY federal prosecutor
but Trump, Sessions and Co. never followed up to have his
appointment confirmed by the Senate.
After 120 days he was appointed to the position by the
federal judges in New York’s Southern District.
So, who can fire him?
Update: Now Berman has changed his mind and has
resigned. Apparently he approves of his
temporary replacement.

Something like "Get out or the US Marshals will throw you out".
Anyone who thought the president couldn't fire anyone in the executive
branch needs a little constitutional tune up.
