discriminate, whereas, if you are an asshole Republican Trump voter,

It is simply a question of what the civil rights act of 64 says and
"gay" is not a protected class. As soon as you start expanding that
definition into unspecified areas the definition is lost, legally.
Scalia is right, the law is what it says it is, not what people may
think it is. That is why it is dangerous to start legislating from the
bench. You are allowing 5 people to make law instead of simply
enforcing it. The courts can say a law is unconstitutional but they
can't write law. That is the job of the legislature.
