It appears that way. You have to listen to the audio portion of the
video carefully to hear his comments to the police. Also, the version of
the video being widely shown by the media is a short version that starts
with the take down. There's a longer version that shows the moments that
led up to the take down where Garner was giving the much smaller cop a bunch of crap.

Bottom line: If you are stopped or detained by the police ... cooperate with them.

And bring your lawyer.
