It is still illegal for a private citizen to sell to an out of state
buyer. If they are willing to ignore that law, why would a law like
Maryland has affect them?

Since there is no paperwork required, how can one prove the private
citizen seller had any idea the private buyer was an out of stater?

"Yeah, he showed me a driver's license. Looked okay to me, but then I'm
no expert about what an out of state driver's license should look like, eh?"
