I heard this whole incident from 2006 as it happened on the scanner. It
was, to say the least, surreal listening to the ordeal as it unwound.
The jerk who swam away was at first thought to be missing/presumed
dead/drowned.

I like the DA's attitude:

"It was absolutely not an accident," said District Attorney John Crandall.
"It was a crime pure and simple."

He's right. DWI is intentional and premeditated. Murder, in other words.
