OT--the dichotomous abortion laws
 
The girl asks the boy to hit her belly with a bat to cause a miscarriage.
The boy gets charged with "intentional conduct against a pregnancy", and the
girl goes free. WTF?

This goes back to the questions I asked eons ago: How can abortion be legal
in the 34 states that have fetal homicide laws? How come the mom and doc
aren't charged with fetal homicide when they abort a fetus? How come the
boyfriend was charged?

It is an overzealous new prosecutor, democrat, in a 'going conservative'
county.
It will most likely get tossed because in order for the charge to stick,
an assault on the pregnant woman must have occurred, since the girl gave
consent, no assault could have taken place.

here's the catch....

Smith charged the boy under a state law passed in 1999 - called the "Prenatal
Protection Act" - that states only the person assaulting a pregnant woman
resulting in a miscarriage is criminally liable. The pregnant woman, no matter
how complicit in the termination, is not.

If that provision had not been written into the statute, it would have clashed
with the federal law that allows abortions under the landmark 1973 Roe v. Wade
U.S Supreme Court decision

Please delineate the rights of a fetus and compare and contrast those with
the rights of a pregnant woman.


You can legally beat a pregnant woman with her consent. Apparently, a fetus
can't give consent to a beating and is protected by the law.
