Cruising Compass report today that the City of Stuart, FL, have
apologised to Vincent Sibilla after he was arrested for anchoring his
yacht for more than 10 days in the City harbour. Sibilla, who sued the
city last month over its anchoring restrictions, has been awarded
$5,000 and a written apology from the city attorney.

This week Stuart commissioners unanimously approved the proposed
settlement with Vincent Sibilla, 68, who filed suit in federal court
March 3, challenging the city's rules about where boaters can anchor.
Sibilla, who lives aboard his 25-foot sloop, Morning Star, will get
his $3,000.00 in attorney fees paid and the City has agreed to change
it’s ordinance on non-liveaboard boats.

The new ordinance will define the term "in navigation" to be in line
with Florida state law. The old ordinance stated that non-liveaboard
boaters are no longer "in navigation" if they are anchored for more
than ten days.

Captain Herman Diebler and SAMI (Sailing Association of Marco Island),
are key players in the fight against unfair restrictions aimed to keep
visiting cruisers away from Florida’s Anchorages. The most recent
“coup” in the anchoring restrictions fight across the Nation was when
they went to battle with the City of Marco Island over local anchoring
restrictions. Diebler and his committee won the first-ever
“precedent-setting” case against Marco Island.

you will find the good Capt Neal the center of several rulings and cited for
precedence on several of his pro se cases. Liveaboards are once again
gaining their freedoms because of the valiant efforts of the good and kind
Capt Neal.

Thank you very much for including my mentor, the World's Famous Capt. Neal,
among the ranks of those famous conservative icons. He, indeed, was
instrumental in restoring for cruising sailors and liveaboards their
God-given rights to be "in navigation."

Governor Charlie Crist is a long-time friend of Captain Neal's and it was
the Good Captain who urged him to issue a clarification of the law
concerning navigation rights when Crist was attorney general of Florida that
re-affirmed navigation rights as well as re-affirmed the original meaning of
a "liveaboard" vessel so cruisers cannot be harrassed by having that term
illegally applied to them.

This opinion was slightly modified, condensed and codified by the Florida
leglislature relying on the attorney general's aforementioned brief.

Some cities still refuse to abide by Florida State law but now-Governor
Crist does not take kindly to their failure to comply with state law.

You can thank the Good Captain Neal for being instrumental in sailors'

Pity that amateur Capt. Neal who willingly places himself in court as
defendant has defeated every State of Florida attempt to find him guilty of
anything and, consequently, has a more successful litigation record than

I don't know about "Neal" but I, Wilbur Hubbard, do not need to Google to
ascertain the meaning of simple words such as precedence and precedents. I
probably learned their meaning in grammar school.

Whereas the average American like yourself has a working vocabulary of only
about 18,000 words, my working vocabulary is closer to 800,000 words. The
English language contains approximately 900,000 words in all so I still have
some time to go before I learn them all.

Please forgive my inattention.

It's very difficult to take any lawyer seriously. (Especially prosecuting
attorney's - they are all pretty much stuck up, staid, inept and have a
holier-than-thou attitude.) For the most part they think they can just waltz
into court and browbeat folks with the law.

Too bad they fail to understand the law from the standpoint of an
intelligent, engaged defense with freedom or money at stake who studies the
law and the language of the law and easily finds when and where it is
specifically and ofttimes intentionally misapplied by the authorities either
out of malice or ignorance and how easy it is to stick it right back up
their ass.

What never occurs to them in the first place is perhaps a defendant wouldn't
even allow something to go to court unless he knew full well he could not
lose simply by using the law and letter of the law in his own defense.

I missed my calling. I would have made one helluva choice Supreme Court
justice.

This has been obvious to anyone who's followed this group for more
than a few years. Wilbur Hubbard (and a few of his aliases) == Capt.
Neal. It's the same **** simpley epackaged under a different name.
