I find it hard to blame the people on the ground in Iraq. They were poorly trained and supervised, sometimes being ordered to "soften up" prisoners by direction from cia-like agencies. While they have and should have been prosecuted for what they did, the actual blame goes much higher. And then you admit confession extracted under torture into your legal process.
