Read the breaking information below and then
try to stand behind a captain who was obviously
totally unqualfied to run the ferry.

"A high-ranking law enforcement source, speaking
on condition of anonymity, said investigators were
probing what part prescription drugs might have
played in the accident.

"Early blood sample results from the pilot, Assistant
Capt. Richard Smith, indicated alcohol was not a factor
in the tragedy, the source said. Smith attempted suicide
after the crash and was hospitalized under police guard;
his condition Friday was listed as critical but stable.

"Investigators also were examining conflicting reports on
the position of other crew members. Under city Department
of Transportation procedures, the pilot and captain are
typically both in the pilot house as the boat enters port.
"If the policy ... was implemented at the time of the accident,
we don't know," Engleman said earlier.

"The NTSB, which is leading the probe, began interviewing
deckhands and engineering crewmembers Thursday, as well
as survivors of the crash and their families. Investigators were
gathering background information on the crew, including
Smith, and were working to create a "72-hour history" leading
up to the crash.

"Authorities said Smith, 55, bolted from the scene of the
crash and twice attempted suicide at his home. He spoke
with police Wednesday but was not interviewed in depth,
Engleman said. Investigators will talk to him when it is
"medically prudent," she said Friday.

"Investigators confirmed that Smith also was at the helm
of the Andrew J. Barberi when it crashed into the Staten
Island dock in July 1995, injuring some passengers.
That accident was blamed on a propeller failure.

"In 1997, Smith was also transferred off captain's duty
at the Staten Island ferry after he refused to let an inspector
interview him and inspect the captain's quarters, a former
transportation commissioner said.

"Christopher Lynn, commissioner in 1996 and 1997, said
Friday he transferred Smith to command a boat that ferried
corpses to a potter's field.

"I drew a very negative imprint from the fact that he
wouldn't let the inspector in," said Lynn, who first
spoke to the New York Post in Friday editions.
"When you have somebody that's carrying 6,000
people in a boat that cost $25 million, I took him off that."

"Lynn said he was stunned to learn that Smith was at the
controls of the crashed ferry. "I thought I had solved
that problem," he said. "

The man has a rather damning history, don't you think?

Classic Nil, when he gets thoroughly trashed and shown to be an idiot he
reverts to sexual innuendo and little hissy fits.

It was easy to see it coming, he stopped trying to defend his COLREGS
troll yesterday and started posting this latest string of whiny one-liners.

Sad I suppose, but what more can you expect from an internet wannabe who
isn't fit for the sea-life he claims.

I've easily won every argument with you tugboat captains
who have proven time and time again you are operating
under a biased view of the COLREGS. You don't read
them or use them as they are written. Rather, you continue
to pick and choose those Rules you feel give you more
rights than you really have. You just hate the fact that
the Rules give sailboats the right of way over motorboats
in most circumstances.

You guys are in a fog even when there is fifty miles of

The International ColRegs don't give any vessel "Right of Way." They only give vessels
obligations. You're the one with the biased view - you demonstrated that in this post!

Its a good thing your license will expire next month.

It really doesn't make any difference. It is worthless in any event
without a lot more qualifications and training than Nil could ever
muster up. Since he couldn't pass the sail test and it is a MOTOR
license he couldn't use it for a sailboat anyway. The best he could do
is maybe harbor tours in an outboard if he can pass a drug test which is
debatable.

His postings here make him a real liability to anyone stupid enough to
consider hiring him. Just imagine when the lawyer for the survivors of
Nil's "command" use some of his posts as evidence of his incompetence.

Sorry Neal, "Right-of-Way" and "Stand-on" do not mean the same thing. In the Inland
Rules, both terms are used. Stand-on means that a vessel is obligated to keep her speed
and course (until conditions necessitate otherwise). Right-of-way is given to downbound
vessels on Western Rivers, and implies that they can dictate the maneuver to an upbound
vessel. In essence, the ROW vessel controls the entire situation.

Now come on Neal, its about time you came clean. You never did take that test, did you?
Its pretty clear that if you had to take it now you wouldn't get 50% right, even if you
were allowed to use the book.

I don't spend my money on food. I spend most of my money
